You leave at 6 AM, drive three hours to the work site, put in a full day, drive back, and walk in your front door at 9 PM. Fifteen hours, no hotel, two meals eaten on the road. Can you get federal per diem for same-day travel with no overnight stay? The answer is yes, if the trip clears one bar: more than 12 hours in travel status. Here is the rule, the math, and the part about taxes that surprises everyone.
The 12-hour rule, exactly as written
The Federal Travel Regulation, 41 CFR 301-11.20, draws the line in one sentence. When travel is more than 12 but less than 24 hours, you receive 75 percent of the applicable M&IE rate for each calendar day in travel status. GSA's own per diem FAQ says the same thing in plainer words: one-day travel away from your official station qualifies if it is longer than 12 hours. Note the wording. More than 12 hours. A trip that runs exactly 12 hours, door to door, does not qualify. Thirteen does.
The math is the same 75 percent you already know from first and last travel days. At the standard CONUS M&IE rate of $68, a qualifying day trip pays $51. In a $92 M&IE locality, it pays $69. There is no lodging component, because the lodging allowance reimburses actual overnight costs and there was no overnight. Anyone who tells you to claim the lodging cap on a day trip is inventing money.
What counts as travel status
The clock is departure to return, and the trip has to be away from your official duty station, outside the local travel area. A 14-hour day that starts and ends at your home office with a long lunch in the middle is not travel. Commuting does not count, even a brutal one. The 12-hour test measures time in travel status, not time feeling tired.
The tax wrinkle
This is the part that stings. Meal money paid for overnight travel is tax-free under an accountable plan. Meal money for same-day travel generally is not. The IRS treats reimbursements for meals on travel without an overnight stay as taxable wages, which means the $51 lands on your W-2. It is still worth claiming; $51 taxed beats $51 out of pocket. But do not do the mental math as if it were the full amount. The overnight traveler keeps the whole M&IE. The day traveler keeps it minus withholding.
